What a silly question :S Its obviously to do with the affect that it has on your body and mind. Tobacco doesn't affect your functioning (well until you get lung cancer anyway), but marijuana does.

A more useful question would be why is alcohol legal when marijuana isn't, as they can, it could be argued, affect your functioning in a similar way.

Alcohol and Marijuana are two different effects. You can still function when you're high. (Like drive or work). However, alcohol intoxication is another story. Tobacco should be the illegal one, seeing as it kills thousands of people each year. There is not one recorded death from marijuana, and there never will be unless the government gets their hands on it like they did tobacco.
